Disclaimers and Release from Liability
I wrote this “Disclaimers Page” to make people aware of the dangers of working with small equipment powered by small engines. I posted these Disclaimers due to potential liabilities and risks because I operate my business in a transparent manner, and there is an old saying “Ignorance is no excuse.” I was a safety leader for Exxon for 10 years, so the best policy is to make this information public, whether you read it or not is up to you.
Warning! Small engines and associated power tools and/or equipment are very dangerous to operate and should be operated by qualified personnel only!
Warning! To avoid serious injuries, do not attempt to use a power tool until you have read and thoroughly understand the operator’s manual completely!!! If you do not understand the warnings and instructions, then it is your responsibility to contact the customer service dept. of the manufacturer.
Warning! “Larry’s Small Engine Service, LLC” will not be responsible for anyone that should get injured if they enter our shop area.
Service! Servicing requires extreme care and knowledge and should only be performed by a qualified service Technician.
NOTE: “Larry’s Small Engine Repair Service, LLC” is an authorized repair facility for several manufactures therefore we might advise you to take it back to the nearest authorized service center for repair if we feel like there is a warranted reason for making that determination.
All CUSTOMERS ARE HEREBY ADVISED AND PLACED ON NOTICE THAT
“Larry’s Small Engine Repair Service, LLC” will not be responsible for any damages or injuries resulting from the misuse, the lack of training or knowledge of his or her power tool.
“Larry’s Small Engine Repair Service, LLC” therefore will not advise a customer on how to use the tool, unless it is in regards to starting the engine or etc.
“Larry’s Small Engine Repair Service, LLC” shall not be held liable for any delays, or issues with respect to delivery of all parts thereof, for any damage incurred from the use of specific parts or information at the customer’s request. The reason being is that some customers want to save time and money by using after-market or used parts because OEM parts may not be readily available or too expensive.
It is the responsibility of the owner of the power tool and/or associated equipment to ensure that they completely and fully understand the operational information provided in the owner/operator’s manual of the power tool and/or associated equipment.
NOTE: As stated by all manufacturers of power tools, you the owner or operator should use the appropriate PPE for personal protection.
NOTE: While the manufacturer may warrant the goods sold to the customer, we make no warranties, express or implied, including any implied warranties of quality, durability or fitness, with respect to such goods.
In any event, “Larry’s Small Engine Repair Service, LLC” will not be held liable to any party for any & all types of damages including, but not limited to, damages for loss of business profits or the interruption of business.
“Larry’s Small Engine Repair Service, LLC” will be responsible for only the repairs we do, if it is maintained and operated per the owners manual. If not, then any damages that should occur after the repairs have been completed will be the sole responsibility of the owner/operator.
“Larry’s Small Engine Repair Service, LLC” shall not be held responsible for any parts that the customer specifies or supplies us with to use if it is not an OEM part. There will be a labor charge, and the cost of a replacement part.
The customer is solely responsible for Shipping and Handling charges.
Special orders & orders placed for a part number specified by the owner from the owner’s documentation is non-refundable and non-returnable.
Prices are subject to change and we reserve the right to change prices because our prices are based on job by job basis.
We will not process any order without the expressed and written approval by the customer and all parts must be paid for in advance.
Depending on the type of equipment there will be a daily storage fee per day imposed once I notify you that it is ready unless prior arrangements are made. Power Tools left after 30 days upon the completion of the repairs can and will be sold to recover all costs associated with the repair job.
